1. Agreement to Terms

By accessing or using SafeGuard ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and Hale Technology Limited ("we", "us", "our") in accordance with the Electronic Commerce (EC Directive) Regulations 2002.

2. Eligibility

You must be at least 16 years of age to create an account and use the Service, in accordance with Section 9 of the Data Protection Act 2018. By registering, you confirm that you meet this age requirement and that the information you provide is accurate and complete.

3. Account Registration

To submit location reports, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security and confidentiality of your password
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised access to your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

When using SafeGuard, you agree not to:

• Submit false, misleading, or inaccurate location reports
• Use the Service to harass, intimidate, threaten, or incite violence or hatred against any individual or group
• Submit content that is defamatory, libellous, or constitutes a criminal offence under UK law, including under the Public Order Act 1986, the Malicious Communications Act 1988, or the Online Safety Act 2023
• Publish personal information about identifiable individuals (other than publicly visible property addresses)
• Attempt to gain unauthorised access to the Service, other user accounts, or our systems, contrary to the Computer Misuse Act 1990
• Use the Service for any unlawful purpose or in violation of any applicable UK law or regulation
• Use automated tools, scrapers, or bots to extract data from the Service
• Interfere with or disrupt the Service or its infrastructure

5. User-Generated Content

5.1 Ownership

You retain ownership of the content you submit (descriptions, notes, reports). By submitting content to SafeGuard, you grant us a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content for the purpose of operating the Service.

5.2 Accuracy and Responsibility

You are solely responsible for the accuracy and legality of the content you submit. Location reports must be based on genuine, good-faith observations. Deliberately submitting false reports may result in account termination and may constitute an offence under UK law.

5.3 Moderation

We reserve the right to review, edit, or remove any content that we reasonably believe violates these Terms, is inaccurate, or is otherwise inappropriate. We are not obligated to monitor all content but may do so at our discretion.

6. Community Standards

SafeGuard exists to help communities share factual information about accommodation placements. All users must:

• Report only factual, verifiable information about property locations and types
• Refrain from discrimination, hate speech, or targeting individuals based on any protected characteristic under the Equality Act 2010
• Respect the dignity and rights of all individuals
• Use the platform for community safety awareness only, not for vigilante activity or unlawful conduct

7. Disclaimers

7.1 No Guarantee of Accuracy

SafeGuard is a community-driven platform. We do not independently verify the accuracy of user-submitted location reports. Information on this platform should not be relied upon as the sole basis for any decision or action. We provide the Service on an "as is" and "as available" basis.

7.2 Not a Substitute for Emergency Services

SafeGuard is an information platform only. In an emergency, always contact the police on 999. For non-emergency concerns, contact 101 or your local council. This platform does not replace, supplement, or interact with any emergency service.

7.3 No Professional Advice

Nothing on SafeGuard constitutes legal, safety, or professional advice. If you have specific safety concerns, please contact the appropriate authorities.

8. Limitation of Liability

To the maximum extent permitted by law, and subject to Section 8.1 below:

• Hale Technology Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claim relating to the Service shall not exceed £100
• We are not liable for the actions of any user or any content submitted by users

8.1 Nothing Excluded

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law, including under the Consumer Rights Act 2015.

9. Intellectual Property

The SafeGuard name, logo, website design, and original content are the property of Hale Technology Limited and are protected by UK copyright law under the Copyright, Designs and Patents Act 1988. Map data is provided by OpenStreetMap contributors under the Open Database License. You may not reproduce, distribute, or create derivative works from our proprietary content without express written permission.

10. Account Termination

We may suspend or terminate your account at any time if:

• You breach these Terms of Service
• We reasonably believe your conduct poses a risk to other users or the Service
• We are required to do so by law

You may delete your account at any time by contacting us at hello@pinkwatch.org. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

11. Indemnification

You agree to indemnify and hold harmless Hale Technology Limited, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. Material changes will be communicated to registered users by email where practicable.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also have additional rights under the laws of the country in which you reside.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
